1 · Age restriction

You must be 18 or older to use this service, opt into any SMS program, submit any form, or purchase any service. By using the services you confirm you are at least 18.

2 · The SMS program

Peak Revenue Solution operates an AI-assisted SMS messaging program. These are the messaging use cases it covers:

  • Lead reactivation — re-engaging dormant contacts in an existing database
  • Speed to lead — responding to new inquiries within seconds of a form submission
  • Out-of-hours coverage — engaging and qualifying people who inquire evenings, weekends, and holidays
  • Appointment booking — booking qualified leads into a calendar over SMS
  • Abandoned cart recovery — following up with customers who did not complete a purchase
  • Google review responses — sending responses to reviews on behalf of clients
  • Appointment reminders — reminders and confirmations to existing clients
  • Marketing messages — offers and promotions, only to contacts who separately consented

3 · Opting out

You may opt out at any time. Text STOP to any message.

We send one final confirmation and then cease all further SMS to that number. You can re-opt in at any time by texting START or submitting a new opt-in form.

4 · Support

Reply HELP to any message, or email [email protected]. We aim to answer every support request within one business day.

5 · Rates and delivery

Message and data rates may apply, and message frequency varies. You are responsible for any charges your mobile carrier applies.

Carriers are not liable for delayed or undelivered messages. Delivery depends on carrier policies, network conditions, and filtering. Carriers may block, filter, or delay messages at their discretion, and we make no guarantee about delivery times or rates.

6 · We never share SMS opt-in data

Phone numbers and SMS opt-in data are never shared, sold, rented, or transferred to any third party or affiliate for marketing purposes. Opt-in information is used solely to communicate with the consenting person as part of the requested service. This has no exceptions.

7 · Your responsibilities as a client

By engaging our services you agree to:

  • Provide accurate and complete business information
  • Confirm you have lawful authority over any lead database you give us
  • Confirm all contacts were obtained lawfully
  • Comply with TCPA, CAN-SPAM, and all applicable communications law
  • Not use the services for any unlawful or harmful purpose

8 · Payment

  • All fees are set out in your service agreement or order confirmation
  • Payment is due on the agreed schedule
  • All fees are in US dollars unless stated otherwise
  • Services may be suspended for non-payment
  • You are responsible for applicable taxes

9 · Limitation of liability

Peak Revenue Solution is not liable for indirect, incidental, or consequential damages arising from your use of the services. Total liability will not exceed the amount you paid in the three months preceding a claim. We do not guarantee specific revenue results.

10 · Governing law

These Terms are governed by the laws of the United States. Disputes are resolved through binding arbitration under the rules of the American Arbitration Association.

11 · Changes, and how to reach us

We may update these Terms. The date at the top reflects the last change, and continued use constitutes acceptance.
